I know this will be a problem, the bird could also be Western. None the less, the bird perched was very dark. Clearly a winter visitor from the western US. There is some red in the tail, but Harlan's can have some red in the tail.
Taking photos was very difficult as the bird was strongly backlit.
I should also point out, that in North East Texas, Harlan's is uncommon but expected in the winter. Western is very rare.
