Can anyone identify the dead tree?

The other pic is of a California Bay Laurel sprout growing in the "dead" tree crotch 8 feet above the ground! If the "dead" tree is bay, maybe it's not really dead. But if it's oak, what do I do? Climb up there and water once a week all summer? Transplant? Let it die where it is?

Dead tree ID please! :-)

Description

Tubular brown scat, about 5 inches long, 3/4 inch in diameter. Very smooth, pointed at one end. No noticeable hair. No tracks or scrapes near it, but in the middle of a gravel driveway. Have ruled out domestic dog, human, etc. due to location, a rural area of private property about 5 miles northeast of Santa Rosa, California in the Mark West Creek watershed.
